Sharendipity?s Procedure for Making Claims of Copyright Infringement

If you believe that any web application ("Content") posted by a Subscriber on the Site in whole or part is protected by a copyright other than that of the Subscriber, and that the Subscriber has not been authorized to do so by the you, your agent or the law, you may notify Sharendipity to have the Content removed or access to the content disabled by providing notification of claimed infringement in writing to Sharendipity at help@Sharendipity.com, including substantially the following:
(a) Your physical or electronic signature, if you are (i) the owner of the allegedly infringed copyright, or (ii) a party authorized to act on behalf of that owner;
(b) Identification of the allegedly infringed copyrighted Content;
(c) The URL or other identification of the location of the Content that is claimed to be infringed;
(d) The name, address, phone number and email address of the party making the complaint;
(e) A statement that you have a good faith belief that use of the Content in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
(f) A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner of the allegedly infringed copyright, or that you are authorized to act on behalf of that owner.

Counter Notification to Sharendipity

If you posted Content on the Site that has been the removed pursuant to Sharendipity?s Procedure for Making Claims of Copyright Infringement, you may notify Sharendipity in writing at help@Sharendipity.com that the Content has been removed or disabled in error, and include substantially the following:
(a) A physical or electronic signature of the Subscriber;
(b) Identification of the Content that has been removed or to which access has been disabled and the URL location at which the Content appeared before it was removed or access to it was disabled;
(c) A statement under penalty of perjury that the Subscriber has a good faith belief that the Content was removed or disabled as a result of mistake or misidentification of the Content to be removed or disabled; and
(d) The Subscriber?s name, address, email address and telephone number, and a statement that the Subscriber consents to the jurisdiction of the United States District Court for the Western District of Wisconsin.

Please be advised that under Digital Millennium Copyright Act, Section 512 (f), any person who knowingly materially misrepresents that (i) Content is infringing, or (ii) Content was removed or disabled by mistake or misidentification may be subject to liability for damages resulting from such misrepresentation including but not limited to attorneys? fees.

Sharendipity enforces a policy that provides for the termination in appropriate circumstances of any Subscriber who is a repeat infringer or who repeatedly make false notifications of alleged infringement.
